A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to prohibiting the Texas Department of Transportation from |
|
|
granting an interest in a state highway to an individual or |
|
|
nongovernmental entity. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 202, Transportation Code, |
|
|
is amended by adding Section 202.003 to read as follows: |
|
|
Sec. 202.003. PROHIBITION AGAINST PRIVATE INTEREST. The |
|
|
department may not grant an individual or nongovernmental entity |
|
|
any interest, including a leasehold interest, in a state highway. |
|
|
SECTION 2. Section 202.003, Transportation Code, as added |
|
|
by this Act, applies only to the sale, lease, or a contract for the |
|
|
sale or lease of real property entered into on or after the |
|
|
effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2007. |
