A BILL TO BE ENTITLED
AN ACT
relating to the deceptive trade practice of charging exorbitant or
excessive prices for fuel during a disaster.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 17.46, Business & Commerce Code, is
amended by adding Subsection (e) to read as follows:
       (e)  For purposes of Subsection (b)(27), a person is
considered to charge an exorbitant or excessive price for fuel if
the price charged by the person for fuel increases more than 20
percent during the period beginning on the day the disaster
occurred or began to occur and ending on the 90th day after the date
of the governor's declaration under Section 418.014, Government
Code.
       SECTION 2.  The change in law made by this Act to Section
17.46, Business & Commerce Code, applies only to the sale or offer
for sale of fuel on or after the effective date of this Act.
       SECTION 3.  This Act takes effect September 1, 2007.
