A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the deceptive trade practice of charging exorbitant or |
|
excessive prices for fuel during a disaster. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 17.46, Business & Commerce Code, is |
|
amended by adding Subsection (e) to read as follows: |
|
(e) For purposes of Subsection (b)(27), a person is |
|
considered to charge an exorbitant or excessive price for fuel if |
|
the price charged by the person for fuel increases more than 20 |
|
percent during the period beginning on the day the disaster |
|
occurred or began to occur and ending on the 90th day after the date |
|
of the governor's declaration under Section 418.014, Government |
|
Code. |
|
SECTION 2. The change in law made by this Act to Section |
|
17.46, Business & Commerce Code, applies only to the sale or offer |
|
for sale of fuel on or after the effective date of this Act. |
|
SECTION 3. This Act takes effect September 1, 2007. |
