A BILL TO BE ENTITLED
 
AN ACT
 
  relating to the regulation of a private business providing security
  services by a political subdivision of this state.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter H, Chapter 1702, Occupations Code, is
  amended by adding Section 1702.184 to read as follows:
         Sec. 1702.184.  LOCAL REGULATION OF CERTAIN SECURITY
  SERVICES FOR PRIVATE BUSINESSES. (a)  Except as provided by
  Subsection (b), a political subdivision of this state may not
  require a private business to contract with or employ a peace
  officer to provide security services for the business.
         (b)  This section does not apply to a requirement that a
  private business contract with or employ a peace officer to provide
  security services for a public event.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2007.
