A BILL TO BE ENTITLED
|
|
AN ACT
|
|
|
relating to the authority of the Railroad Commission of Texas to |
|
regulate warning signs appurtenant to certain pipeline facilities; |
|
providing an administrative penalty. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 91, Natural Resources Code, is amended |
|
by adding Subchapter P to read as follows: |
|
SUBCHAPTER P. PIPELINE FACILITY WARNING SIGNS |
|
Sec. 91.701. COMMISSION JURISDICTION OVER PIPELINE |
|
FACILITY WARNING SIGNS. (a) In this section, "hazardous liquid" |
|
has the meaning assigned by Section 117.001. |
|
(b) The commission has exclusive jurisdiction over warning |
|
signs appurtenant to natural gas and hazardous liquid pipelines, |
|
gathering lines that are subject to commission jurisdiction over |
|
safety standards as provided by Sections 117.011 and 117.012 of |
|
this code and Section 121.201, Utilities Code, and distribution |
|
facilities. |
|
Sec. 91.702. RULES. The commission may adopt all necessary |
|
rules governing warning signs described by Section 91.701. |
|
Sec. 91.703. ADMINISTRATIVE PENALTY. A violation of a rule |
|
adopted under this subchapter is considered to be a violation of a |
|
provision of a rule that pertains to safety and is issued under this |
|
title for purposes of Section 81.0531. |
|
SECTION 2. This Act takes effect September 1, 2007. |
