A BILL TO BE ENTITLED
AN ACT
relating to establishment of a pilot program to provide early
identification of public school students at risk of dropping out of
school.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter C, Chapter 29, Education Code, is
amended by adding Section 29.096 to read as follows:
       Sec. 29.096.  EARLY WARNING DATA SYSTEM PILOT PROGRAM. (a)
Using funds appropriated for that purpose, the commissioner by
rule shall establish a pilot program under which a participating
school district, with assistance from the agency, creates an early
warning data system to identify students likely to become at risk of
dropping out of school, as described by Section 29.081(d).
       (b)  The commissioner shall select to participate in the
pilot program school districts that have relatively high numbers of
students dropping out of school.
       (c)  An early warning data system created under the pilot
program must use student performance data and other indicators to
identify at the earliest possible time students likely to become at
risk of dropping out of school, as described by Section 29.081(d),
so that appropriate intervention services may be provided to the
students by the district.
       (d)  The commissioner shall adopt rules necessary to
implement the pilot program.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
