A BILL TO BE ENTITLED

AN ACT
|
|
relating to the designation by name of parts of the highway system. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 225.001, Transportation Code, is amended |
|
to read as follows: |
|
Sec. 225.001. RESTRICTIONS [PROHIBITION] ON NAMING |
|
HIGHWAY. (a) The commission may not designate a part of the |
|
highway system, including a bridge or street, by a name, including |
|
the name of a living [or dead] individual or for an organization or |
|
event, or by a symbol other than the regular highway number. |
|
(b) Except as otherwise provided by statute, a part of the |
|
highway system, including a bridge or street, may not be designated |
|
by a name. |
|
(c) A part of the highway system, including a bridge or |
|
street, may be designated by the name of a person only if the person |
|
is deceased and was significant: |
|
(1) in the state's history; or |
|
(2) in the lives of the people of this state. |
|
SECTION 2. Section 225.021, Transportation Code, is amended |
|
by adding Subsections (c) and (d) to read as follows: |
|
(c) The department is not required to design, construct, or |
|
erect a marker under this subchapter unless a grant or donation of |
|
funds is made to the department to cover the cost of the design, |
|
construction, and erection of the marker. |
|
(d) Money received under Subsection (b) shall be deposited |
|
to the credit of the state highway fund. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
