A BILL TO BE ENTITLED
 
AN ACT
 
  relating to the designation by name of parts of the highway system.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 225.001, Transportation Code, is amended
  to read as follows:
         Sec. 225.001.  RESTRICTIONS [PROHIBITION] ON NAMING
  HIGHWAY.  (a)  The commission may not designate a part of the
  highway system, including a bridge or street, by a name, including
  the name of a living [or dead] individual or for an organization or
  event, or by a symbol other than the regular highway number.
         (b)  Except as otherwise provided by statute, a part of the
  highway system, including a bridge or street, may not be designated
  by a name.
         (c)  A part of the highway system, including a bridge or
  street, may be designated by the name of a person only if the person
  is deceased and was significant:
               (1)  in the state's history; or
               (2)  in the lives of the people of this state.
         SECTION 2.  Section 225.021, Transportation Code, is amended
  by adding Subsections (c) and (d) to read as follows:
         (c)  The department is not required to design, construct, or
  erect a marker under this subchapter unless a grant or donation of
  funds is made to the department to cover the cost of the design,
  construction, and erection of the marker.
         (d)  Money received under Subsection (b) shall be deposited
  to the credit of the state highway fund.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2007.
