A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the composition of the board of navigation and canal |
|
|
commissioners of the Victoria County Navigation District. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subtitle A, Title 5, Special District Local Laws |
|
|
Code, is amended by adding Chapter 5005 to read as follows: |
|
|
CHAPTER 5005. VICTORIA COUNTY NAVIGATION DISTRICT |
|
|
SUBCHAPTER A. GENERAL PROVISIONS |
|
|
Sec. 5005.001. DEFINITIONS. In this chapter: |
|
|
(1) "Board" means the board of navigation and canal |
|
|
commissioners of the Victoria County Navigation District. |
|
|
(2) "District" means the Victoria County Navigation |
|
|
District. |
|
|

SUBCHAPTER B. BOARD |
|
|
Sec. 5005.051. COMPOSITION OF BOARD. The district is |
|
|
governed by a board of five navigation and canal commissioners |
|
|
appointed by the Commissioners Court of Victoria County. |
|
|
SECTION 2. (a) A navigation and canal commissioner of the |
|
|
Victoria County Navigation District serving on the effective date |
|
|
of this Act continues to serve until the expiration of the term for |
|
|
which the commissioner was appointed. |
|
|
(b) The Commissioners Court of Victoria County shall make |
|
|
appointments to the board of navigation and canal commissioners of |
|
|
the Victoria County Navigation District to achieve, as soon as |
|
|
practicable, the composition prescribed by Section 5005.051, |
|
|
Special District Local Laws Code, as added by this Act. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
