A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to an exception under the public information law regarding |
|
the name of an applicant for superintendent of a public school |
|
district. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 552.126, Government Code, is amended to |
|
read as follows: |
|
Sec. 552.126. EXCEPTION: NAME OF APPLICANT FOR |
|
SUPERINTENDENT OF PUBLIC SCHOOL DISTRICT. (a) The name of an |
|
applicant for the position of superintendent of a public school |
|
district is excepted from the requirements of Section 552.021, |
|
except that the board of trustees must give public notice of the |
|
name or names of the finalists being considered for the position at |
|
least 21 days before the date of the meeting at which a final action |
|
or vote is to be taken on the employment of the person. |
|
(b) For purposes of this section, a person is considered to |
|
be a finalist for the position of superintendent of a public school |
|
district if the person was formally interviewed by the board of |
|
trustees in the final round of interviews for the position. |
|
SECTION 2. Section 552.126, Government Code, as amended by |
|
this Act, applies to an interview for the position of |
|
superintendent of a public school district held on or after the |
|
effective date of this Act. An interview held before the effective |
|
date of this Act is governed by the law as it existed immediately |
|
before that date, and the former law is continued in effect for that |
|
purpose. |

SECTION 3. This Act takes effect September 1, 2007. |
