A BILL TO BE ENTITLED
 
AN ACT
 
  relating to an exception under the public information law regarding
  the name of an applicant for superintendent of a public school
  district.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 552.126, Government Code, is amended to
  read as follows:
         Sec. 552.126.  EXCEPTION: NAME OF APPLICANT FOR
  SUPERINTENDENT OF PUBLIC SCHOOL DISTRICT. (a)  The name of an
  applicant for the position of superintendent of a public school
  district is excepted from the requirements of Section 552.021,
  except that the board of trustees must give public notice of the
  name or names of the finalists being considered for the position at
  least 21 days before the date of the meeting at which a final action
  or vote is to be taken on the employment of the person.
         (b)  For purposes of this section, a person is considered to
  be a finalist for the position of superintendent of a public school
  district if the person was formally interviewed by the board of
  trustees in the final round of interviews for the position.
         SECTION 2.  Section 552.126, Government Code, as amended by
  this Act, applies to an interview for the position of
  superintendent of a public school district held on or after the
  effective date of this Act. An interview held before the effective
  date of this Act is governed by the law as it existed immediately
  before that date, and the former law is continued in effect for that
  purpose.
         SECTION 3.  This Act takes effect September 1, 2007.
