A BILL TO BE ENTITLED
AN ACT
relating to the use of eminent domain for highway or other
transportation purposes.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subtitle Z, Title 6, Transportation Code, is
amended by adding Chapter 473 to read as follows:
CHAPTER 473. USE OF EMINENT DOMAIN FOR TRANSPORTATION PURPOSES
       Sec. 473.001.  ADEQUATE COMPENSATION REQUIRED. An entity
authorized to condemn property for highway or other transportation
purposes may not condemn property unless the entity pays adequate
compensation to the property owner, taking into account all factors
used to determine the market value of the property for ad valorem
tax purposes.
       Sec. 473.002.  NOTICE TO LEGISLATOR REQUIRED. Not later
than the 30th day after the date an entity first takes official
action to initiate condemnation proceedings for a highway or other
transportation purpose, the entity shall provide written notice of
the action to each state legislator in whose district the property
lies.
       SECTION 2.  This Act takes effect September 1, 2007.
