A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the annexation of a municipally owned airport. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter E, Chapter 43, Local Government Code, |
|
|
is amended by adding to Section 43.102 a new Subsection (f) to read |
|
|
as follows: |
|
|
(f) A home rule municipality with a population between 9,000 |
|
|
and 9,100 may annex a noncontiguous airport owned by such |
|
|
municipality, and other areas in the proximity of such airport, |
|
|
provided such annexation is otherwise in compliance with the |
|
|
requirements of this section. If the area proposed for annexation |
|
|
lies within the extraterritorial jurisdiction of another |
|
|
municipality, such municipality may give its consent to the |
|
|
reduction in its extraterritorial jurisdiction in the manner |
|
|
provided in Section 42.023, provided, however, that if such |
|
|
reduction would cause an area to be surrounded by territory within |
|
|
the jurisdiction of the consenting municipality, whether such |
|
|
jurisdiction is full-purpose, limited-purpose, or |
|
|
extraterritorial, then the governing body of the consenting |
|
|
municipality must find that surrounding the area is in the public |
|
|
interest. |

|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007 |
