A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to prohibiting a local mental health or mental retardation |
|
authority or an affiliate of an authority from providing certain |
|
services. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter B, Chapter 533, Health and Safety |
|
Code, is amended by adding Section 533.051 to read as follows: |
|
Sec. 533.051. LOCAL AUTHORITY PROVISION OF EMPLOYEE |
|
ASSISTANCE SERVICES. (a) In this section "employee assistance |
|
program" means an employer's program to provide assessment and |
|
counseling to its employees or to its employees' families to assist |
|
in personal matters, which may include alcohol or chemical abuse, |
|
marriage or family problems, stress-related problems, financial |
|
problems, legal problems, psychological issues, workplace |
|
conflict, or similar matters. |
|
(b) A local mental health or mental retardation authority or |
|
an entity affiliated with an authority may not provide employee |
|
assistance program services. |
|
SECTION 2. (a) The changes in law made by this Act do not |
|
apply to the provision of employee assistance program services by a |
|
local mental health or mental retardation authority or an entity |
|
affiliated with an authority to the extent that a contract entered |
|
into before the effective date of this Act requires the authority or |
|
affiliated entity to perform the services. |
|
(b) A local mental health or mental retardation authority or |
|
an entity affiliated with an authority may not renew a contract |
|
described by Subsection (a) of this section on or after the |
|
effective date of this Act. |
|
SECTION 3. This Act takes effect September 1, 2007. |
