A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the compensation of Texas Department of Transportation |
|
|
employees for certain compensatory time. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter F, Chapter 201, Transportation Code, |
|
|
is amended by adding Section 201.407 to read as follows: |
|
|
Sec. 201.407. PAYMENT FOR COMPENSATORY TIME. |
|
|
(a) Notwithstanding any other law, the department may compensate |
|
|
employees of the department, whether subject to or exempt from the |
|
|
overtime pay provisions of the Fair Labor Standards Act of 1938 (29 |
|
|
U.S.C. Section 201 et seq.), for compensatory time earned when |
|
|
taking compensatory time off would be disruptive to the |
|
|
department's normal business functions. |
|
|
(b) The rate of compensation authorized under this section |
|
|
is equal to the employee's regular rate of pay. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
