A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the powers of the West Fort Bend Management District. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 3835, Local Government Code, is amended |
|
|
by adding Section 3835.109 as follows: |
|
|
Sec. 3835.109. ANNEXATION. (a) In addition to the |
|
|
authority to annex territory under Subchapter C, Chapter 375, Local |
|
|
Government Code, and Subchapter J, Chapter 49, Water Code, the |
|
|
district has the authority to annex territory located in the |
|
|
corporate limits or extraterritorial jurisdictions of the City of |
|
|
Rosenberg or the City of Richmond at the request of the City of |
|
|
Rosenburg or the City of Richmond in the manner set forth in this |
|
|
section. |
|
|
(b) The governing body in whose corporate limits or |
|
|
extraterritorial jurisdiction the territory is located is located |
|
|
shall adopt a resolution or ordinance requesting the annexation. |
|
|
The Board shall conduct a public hearing and consider the request of |
|
|
the city. |
|
|
(c) The Board may annex the territory into the district if |
|
|
the Board determines that it is feasible, practicable, and to the |
|
|
advantage of the district. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
