A BILL TO BE ENTITLED
|
|
AN ACT
|
|
|
relating to the annexation powers of the West Fort Bend Management |
|
District. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter C, Chapter 3835, Special District |
|
Local Laws Code, is amended by adding Section 3835.109 to read as |
|
follows: |
|
Sec. 3835.109. ANNEXATION IN OR NEAR CITY. (a) In |
|
addition to the authority to annex territory under Subchapter C, |
|
Chapter 375, Local Government Code, and Subchapter J, Chapter 49, |
|
Water Code, the district may annex territory in the corporate |
|
limits or extraterritorial jurisdictions of the City of Rosenberg |
|
or the City of Richmond if: |
|
(1) the governing body of the city requests the |
|
annexation of its territory by ordinance or resolution; |
|
(2) the board holds a hearing to consider the city's |
|
request; and |
|
(3) the board determines that it is feasible, |
|
practicable, and to the district's advantage. |
|
(b) The district may not annex a single-family residence |
|
under this section. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
