A BILL TO BE ENTITLED
 
AN ACT
 
  relating to the annexation powers of the West Fort Bend Management
  District.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter C, Chapter 3835, Special District
  Local Laws Code, is amended by adding Section 3835.109 to read as
  follows:
         Sec. 3835.109.  ANNEXATION IN OR NEAR CITY.  (a)  In
  addition to the authority to annex territory under Subchapter C,
  Chapter 375, Local Government Code, and Subchapter J, Chapter 49,
  Water Code, the district may annex territory in the corporate
  limits or extraterritorial jurisdictions of the City of Rosenberg
  or the City of Richmond if:
               (1)  the governing body of the city requests the
  annexation of its territory by ordinance or resolution;
               (2)  the board holds a hearing to consider the city's
  request; and
               (3)  the board determines that it is feasible,
  practicable, and to the district's advantage.
         (b)  The district may not annex a single-family residence
  under this section.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2007.
