A BILL TO BE ENTITLED
 
AN ACT
  relating to the authority of certain general-law municipalities to
  add area to their extraterritorial jurisdiction on the request of
  area property owners.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter B, Chapter 42, Local Government Code,
  is amended by adding Section 42.027 to read as follows:
         Sec. 42.027.  AUTHORITY OF GENERAL-LAW MUNICIPALITY TO
  INCLUDE AREA IN EXTRATERRITORIAL JURISDICTION ON REQUEST OF AREA
  PROPERTY OWNERS. (a)  This section applies only to a general-law
  municipality that has an extraterritorial jurisdiction of more than
  one mile at any point contiguous to the municipality's corporate
  boundaries.
         (b)  If a majority of the property owners of an area
  contiguous to the municipality's extraterritorial jurisdiction
  sign a petition in favor of becoming a part of the municipality's
  extraterritorial jurisdiction, any three of those property owners
  may prepare an affidavit regarding the petition and file the
  affidavit, with a metes and bounds description of the area
  attached, with the presiding officer of the governing body of the
  municipality.
         (c)  The presiding officer of the governing body of the
  municipality shall certify the filed affidavit, with a metes and
  bounds description of the area attached, to the governing body of
  the municipality. On receipt of the certified affidavit, with a
  metes and bounds description of the area attached, the governing
  body by ordinance may include the described area in the
  municipality's extraterritorial jurisdiction.
         (d)  On the effective date of the ordinance, the described
  area becomes a part of the municipality's extraterritorial
  jurisdiction and the inhabitants of the area are bound by the acts
  and ordinances adopted by the municipality that apply to the
  municipality's extraterritorial jurisdiction.
         SECTION 2.  This Act takes effect September 1, 2007.
