A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to providing notice of a required court appearance to a |
|
|
criminal defendant and the defendant's surety. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 17, Code of Criminal Procedure, is |
|
|
amended by adding Article 17.085 to read as follows: |
|
|
Art. 17.085. NOTICE OF APPEARANCE DATE. Not later than the |
|
|
fifth day preceding the date a defendant who has posted a bail bond |
|
|
is required to appear before a court, the court shall give notice of |
|
|
the appearance date to: |
|
|
(1) the defendant; and |
|
|
(2) the surety on the defendant's bond. |
|
|
SECTION 2. This Act applies only to a bond issued on or |
|
|
after the effective date of this Act. A bond issued before the |
|
|
effective date of this Act is governed by the law in effect at the |
|
|
time the bond was issued, and the former law is continued in effect |
|
|
for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2007. |
