A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the award of a contract by an airport authority created |
|
|
by certain municipalities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 252.043, Local Government Code, is |
|
|
amended by adding Subsection (b-1) to read as follows: |
|
|
(b-1) In addition to the considerations provided by |
|
|
Subsection (b), a joint board described by Section 22.074(d), |
|
|
Transportation Code, that awards contracts in the manner provided |
|
|
by this chapter may consider, in determining the best value for the |
|
|
board, the impact on the ability of the board to comply with laws, |
|
|
rules, and programs relating to contracting with small businesses, |
|
|
as defined by 13 C.F.R. Section 121.201. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
