A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the eligibility of certain teachers to serve on the |
|
State Board of Education and the board of directors of a regional |
|
education service center. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 7.101, Education Code, is amended to |
|
read as follows: |
|
Sec. 7.101. COMPOSITION. (a) The State Board of Education |
|
is composed of 15 voting members elected from districts and two |
|
nonvoting members, selected as provided by Subsection (c). Each |
|
district from which a board member is elected is composed as |
|
provided by the court order dated November 2, 2001, in Miller v. Cuellar, No. 3-01CV1072-a (N.D. Tex.) |

|
(b) Voting members [Members] of the board are elected at |
|
biennial general elections held in compliance with the Election |
|
Code. |
|
(c) Notwithstanding any other provision of this subchapter, |
|
a teacher who is selected as the state elementary teacher of the |
|
year or the state secondary teacher of the year under a program |
|
adopted by the agency is entitled to serve as a nonvoting member of |
|
the board until a new state teacher of the year is selected to serve |
|
in the capacity in which the teacher was serving. |
|
SECTION 2. Section 8.003(b), Education Code, is amended to |
|
read as follows: |
|
(b) The commissioner shall adopt rules to provide for the |
|
local selection, appointment, and continuity of membership of |
|
regional education service center boards of directors. The rules |
|
must provide that a teacher who is selected as a regional teacher of |
|
the year under a program adopted by the agency is entitled to serve |
|
as a nonvoting member of the board of directors for that region. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
