A BILL TO BE ENTITLED
AN ACT
relating to training required for employees of persons licensed to
provide certain home and community support services.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter A, Chapter 142, Health and Safety
Code, is amended by adding Section 142.0021 to read as follows:
       Sec. 142.0021.  PERSONAL ASSISTANCE SERVICES MINIMUM
TRAINING STANDARDS.  (a)  The executive commissioner of the Health
and Human Services Commission shall adopt rules prescribing minimum
training standards for an employee of a person licensed to provide
personal assistance services under this chapter.
       (b)  The minimum training standards must require that, not
later than the 120th day after the date an employee is initially
hired to provide personal assistance services, the employee
complete at least 16 hours of training.
       (c)  The minimum training standards must require training in
at least the following areas:
             (1)  cultural sensitivity;
             (2)  communication skills;
             (3)  proper lifting and moving techniques;
             (4)  safe cooking techniques; and
             (5)  dementia and Alzheimer-related issues.
       (d)  The Department of Aging and Disability Services shall
ensure that a person licensed to provide personal assistance
services under this chapter provides training to the person's
employees that complies with the requirements of this section.
       SECTION 2.  Section 142.0021(b), Health and Safety Code, as
added by this Act, applies to an employee hired on or after the
effective date of the rules adopted in compliance with Section
142.0021(a), Health and Safety Code, as added by this Act.
       SECTION 3.  This Act takes effect September 1, 2007.
