A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to information provided to a plaintiff in a small claims |
|
|
court by a defendant against whom judgment is rendered. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 28.051(b), Government Code, is amended |
|
|
to read as follows: |
|
|
(b) If the judgment is against the defendant, the defendant |
|
|
shall pay the judgment immediately. A judgment entered against a |
|
|
defendant must require that if the defendant does not pay the |
|
|
judgment immediately, the defendant must provide the plaintiff with |
|
|
the defendant's: |
|
|
(1) street address and mailing address, if different; |
|
|
(2) driver's license number or state identification |
|
|
number; and |
|
|
(3) employer's name and address. |
|
|
SECTION 2. Section 28.051(b), Government Code, as amended |
|
|
by this Act, applies only to a judgment rendered against a defendant |
|
|
on or after the effective date of this Act. A judgment rendered |
|
|
before the effective date of this Act is governed by the law |
|
|
applicable immediately before the effective date of this Act, and |
|
|
that law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2007. |
