A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the satisfaction of a condition of community |
|
supervision requiring performance of community service. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 16, Article 42.12, Code of Criminal |
|
Procedure, is amended by adding Subsection (f) to read as follows: |
|
(f) A judge may permit a defendant to substitute for |
|
community service otherwise required by this section a one-time |
|
payment to the community supervision and corrections department |
|
supervising the defendant, a charitable organization, or a drug |
|
court. For each amount contributed under this subsection that |
|
equals the amount of the federal minimum wage, the defendant is |
|
entitled to one hour's credit against required community service |
|
hours. |
|
SECTION 2. The change in law made by this Act applies to a |
|
defendant placed on community supervision before, on, or after the |
|
effective date of this Act. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
