A BILL TO BE ENTITLED
AN ACT
relating to the satisfaction of a condition of community
supervision requiring performance of community service.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 16, Article 42.12, Code of Criminal
Procedure, is amended by adding Subsection (f) to read as follows:
       (f)  A judge may permit a defendant to substitute for
community service otherwise required by this section a one-time
payment to the community supervision and corrections department
supervising the defendant, a charitable organization, or a drug
court. For each amount contributed under this subsection that
equals the amount of the federal minimum wage, the defendant is
entitled to one hour's credit against required community service
hours.
       SECTION 2.  The change in law made by this Act applies to a
defendant placed on community supervision before, on, or after the
effective date of this Act.
       SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
