A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to agreements between certain municipalities and counties |
|
to provide law enforcement services in unincorporated areas. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 362, Local Government Code, is amended |
|
by adding Section 362.005 to read as follows: |
|
Sec. 362.005. AGREEMENTS FOR LAW ENFORCEMENT SERVICES IN |
|
UNINCORPORATED AREA OF CERTAIN COUNTIES. (a) This section applies |
|
only to a county with a population of one million or more in which |
|
both the county and the largest municipality located in the county |
|
have adopted Chapter 174. |
|
(b) A county commissioners court by resolution may contract |
|
with the largest municipality in the county to provide law |
|
enforcement service to the unincorporated area of the county. A |
|
police officer of the municipality has the same authority and |
|
powers of arrest, search, and seizure as a deputy sheriff of the |
|
county. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
