A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of certain counties to enact setback |
|
|
regulations in an area of a future highway. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 233.032, Local Government Code, is |
|
|
amended by adding Subsection (d) to read as follows: |
|
|
(d) In a county with a population of more than 225,000 that |
|
|
contains a municipality with a population of more than 190,000, a |
|
|
major highway may include a defined area in the unincorporated area |
|
|
of the county that is identified by the county's metropolitan |
|
|
planning organization as the corridor for a future highway. The |
|
|
time limit imposed by Section 233.034(c) does not apply to a setback |
|
|
for a major highway authorized by this section. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
