A BILL TO BE ENTITLED
AN ACT
relating to the authority of certain counties to enact setback
regulations in an area of a future highway.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 233.032, Local Government Code, is
amended by adding Subsection (d) to read as follows:
       (d)  In a county with a population of more than 225,000 that
contains a municipality with a population of more than 190,000, a
major highway may include a defined area in the unincorporated area
of the county that is identified by the county's metropolitan
planning organization as the corridor for a future highway. The
time limit imposed by Section 233.034(c) does not apply to a setback
for a major highway authorized by this section.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
