A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the costs of conducting a civil commitment proceeding |
|
for a sexually violent predator. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 841.146(c), Health and Safety Code, is |
|
amended to read as follows: |
|
(c) The [In an amount not to exceed $2,500, the] State of |
|
Texas shall pay all reasonable costs of: |
|
(1) [associated with] a civil commitment proceeding |
|
conducted under Subchapter D; |
|
(2) [. The State of Texas shall pay the reasonable
|
|
costs of] state or appointed counsel or experts for a [any other] |
|
civil commitment proceeding conducted under Subchapter F or G; and |
|
(3) [this chapter and shall pay the reasonable costs
|
|
of] the person's outpatient treatment and supervision. |
|
SECTION 2. The change in law made by this Act applies only |
|
to an individual who on or after September 1, 2007, is serving a |
|
sentence in the Texas Department of Criminal Justice or is |
|
committed to the Department of State Health Services or the |
|
Department of Aging and Disability Services for an offense |
|
committed before, on, or after the effective date of this Act. |
|
SECTION 3. This Act takes effect September 1, 2007. |
