A BILL TO BE ENTITLED

AN ACT
|
|
|
relating to the voluntary disclosure of public information. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 552.007, Government Code, is amended by |
|
|
amending Subsection (b) and adding Subsection (c) to read as |
|
|
follows: |
|
|
(b) Release of information held by a prosecutor to a |
|
|
licensed attorney representing a defendant in pending or reasonably |
|
|
anticipated criminal litigation does not constitute a voluntary |
|
|
disclosure for purposes of this section and does not foreclose a |
|
|
governmental body's assertion of the exceptions to required |
|
|
disclosure under Subchapter C with respect to the released |
|
|
information. |
|
|
(c) Except as provided by Subsection (b), public |
|
|
information made available under Subsection (a) must be made |
|
|
available to any person. |
