A BILL TO BE ENTITLED
AN ACT
relating to the powers of the Southmost Regional Water Authority.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Chapter 511, Acts of the 67th Legislature,
Regular Session, 1981, is amended by adding Section 7A to read as
follows:
       Sec. 7A.  (a)  The authority is authorized to purchase,
construct, acquire, own, lease, operate, maintain, repair,
improve, and extend inside and outside its boundaries, at any
location whatsoever, in the sole discretion of the authority, land
and interest in land, any and all works, improvements, facilities,
plants, equipment, and appliances incident, helpful, or necessary
to provide for the collection, transportation, processing,
disposal, and control of all domestic, industrial, or communal
wastes, whether fluids, solids, or composites.
       (b)  The authority shall have the authority to perform any
act consistent with the powers granted under Subsection (a) of this
section, including the authority to contract with any person or
public or private entity in the performance of a purpose or power
granted by this section. To accomplish the purposes of this
section, the authority has all the powers and rights of procedure,
financing, construction, maintenance, rehabilitation, operation,
rulemaking, and administration conferred by Section 59, Article
XVI, Texas Constitution, this Act, and Chapters 49 and 51, Water
Code.
       SECTION 2.  (a) The proper and legal notice of the intention
to introduce this Act, setting out the general substance of this
Act, has been published as provided by law, and the notice and a
copy of this Act have been furnished to all persons, agencies,
officials, or entities to which they are required to be furnished by
the constitution and other laws of this state, including the
governor, who has submitted the notice and this Act to the Texas
Commission on Environmental Quality.
       (b)  The Texas Commission on Environmental Quality has filed
its recommendations relating to this Act with the governor,
lieutenant governor, and speaker of the house of representatives
within the required time.
       (c)  All requirements of the constitution and laws of this
state and the rules and procedures of the legislature with respect
to notice, introduction, and passage of this Act are fulfilled and
accomplished.
       SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
