A BILL TO BE ENTITLED
AN ACT
relating to the governing board of certain independent school
districts and certain junior college districts.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Subchapter E, Chapter 130, Education Code, is
amended by adding Section 130.0824 to read as follows:
       Sec. 130.0824.  GOVERNING BOARD OF CERTAIN DISTRICTS.  
(a)  This section applies only to a member of the governing board of
a junior college district located in a county with a population of
more than 3.3 million.
       (b)  A member of the governing board of a junior college
district serves a staggered term of four years.
       (c)  A member of the governing board of a junior college
district who becomes a candidate in any general, special, or
primary election for a state, federal, or municipal office must
resign as a member of the board.
       SECTION 2.  Subchapter C, Chapter 11, Education Code, is
amended by adding Section 11.066 to read as follows:
       Sec. 11.066.  BOARD OF TRUSTEES IN CERTAIN SCHOOL DISTRICTS.  
A member of the board of trustees of an independent school district
located in a county with a population of more than 3.3 million who
becomes a candidate in any general, special, or primary election
for a state, federal, or municipal office must resign as a member of
the board.
       SECTION 3.  (a)  The change in law made this Act by adding
Section 130.0824(b), Education Code, applies only to the term of a
member of a governing board of a junior college district who is
appointed or elected on or after the effective date of this Act.
       (b)  The governing board shall designate the terms of a
governing board member appointed or elected after the effective
date of this Act as necessary to maintain staggered terms or comply
with any other applicable provision of law.
       SECTION 4.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
