A BILL TO BE ENTITLED
AN ACT
relating to the establishment of a school-based influenza
vaccination pilot program.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  (a)  The Department of State Health Services and
the Texas Education Agency shall jointly establish a school-based
influenza vaccination pilot program using both killed vaccine and
live attenuated vaccine in:
             (1)  a school district with a student population that
is at least 90 percent economically disadvantaged and is located in
a home-rule municipality with a population of more than 1.1 million
that relies on a sole source aquifer for more than 50 percent of the
municipality's water; and
             (2)  a rural school district.
       (b)  The Department of State Health Services shall convene a
working group to plan the school-based influenza vaccination pilot
program established under this section. The working group shall
include representatives from:
             (1)  the Texas Pediatric Society;
             (2)  the Texas Academy of Family Practice;
             (3)  a manufacturer of killed influenza vaccine;
             (4)  a manufacturer of live attenuated influenza
vaccine;
             (5)  each school district in which the pilot program
will operate;
             (6)  the Texas Education Agency; and
             (7)  the state Medicaid medical director.
       (c)  Not later than January 1, 2009, the Department of State
Health Services and the Texas Education Agency shall submit to the
governor, lieutenant governor, speaker of the house of
representatives, and presiding officers of each standing committee
of the legislature with jurisdiction over the department and the
agency a jointly written report containing the results and the
recommendations of the department and the agency to continue,
expand, or terminate the school-based influenza vaccination pilot
program.
       (d)  The Department of State Health Services and the Texas
Education Agency may seek, receive, and spend money received
through an appropriation, grant, donation, or reimbursement from
any public or private source to implement the school-based
influenza vaccination pilot program.
       SECTION 2.  This Act expires September 1, 2009.
       SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
