A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the establishment of a school-based influenza |
|
vaccination pilot program. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. (a) The Department of State Health Services and |
|
the Texas Education Agency shall jointly establish a school-based |
|
influenza vaccination pilot program using both killed vaccine and |
|
live attenuated vaccine in: |
|
(1) a school district with a student population that |
|
is at least 90 percent economically disadvantaged and is located in |
|
a home-rule municipality with a population of more than 1.1 million |
|
that relies on a sole source aquifer for more than 50 percent of the |
|
municipality's water; and |
|
(2) a rural school district. |
|
(b) The Department of State Health Services shall convene a |
|
working group to plan the school-based influenza vaccination pilot |
|
program established under this section. The working group shall |
|
include representatives from: |
|
(1) the Texas Pediatric Society; |
|
(2) the Texas Academy of Family Practice; |
|
(3) a manufacturer of killed influenza vaccine; |
|
(4) a manufacturer of live attenuated influenza |
|
vaccine; |
|
(5) each school district in which the pilot program |
|
will operate; |
|
(6) the Texas Education Agency; and |
|
(7) the state Medicaid medical director. |
|
(c) Not later than January 1, 2009, the Department of State |
|
Health Services and the Texas Education Agency shall submit to the |
|
governor, lieutenant governor, speaker of the house of |
|
representatives, and presiding officers of each standing committee |
|
of the legislature with jurisdiction over the department and the |
|
agency a jointly written report containing the results and the |
|
recommendations of the department and the agency to continue, |
|
expand, or terminate the school-based influenza vaccination pilot |
|
program. |
|
(d) The Department of State Health Services and the Texas |
|
Education Agency may seek, receive, and spend money received |
|
through an appropriation, grant, donation, or reimbursement from |
|
any public or private source to implement the school-based |
|
influenza vaccination pilot program. |
|
SECTION 2. This Act expires September 1, 2009. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2007. |
