A BILL TO BE ENTITLED
AN ACT
relating to a study and report of the feasibility of establishing a
school-based influenza vaccination pilot program.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  (a)  The Department of State Health Services
shall conduct a study of the feasibility of establishing a
school-based influenza vaccination pilot program.
       (b)  The feasibility study must:
             (1)  examine the costs and benefits of establishing a
school-based influenza vaccination pilot program in:
                   (A)  a school district with a student population
that is at least 90 percent economically disadvantaged and is
located in a home-rule municipality with a population of more than
1.1 million that relies on a sole source aquifer for more than 50
percent of the municipality's water; and
                   (B)  a rural school district;
             (2)  identify any barriers to implementing the
school-based influenza vaccination pilot program and recommend
strategies for removing the barriers; and
             (3)  determine the fiscal impact to this state of the
proposed pilot program.
       (c)  Not later than January 1, 2009, the Department of State
Health Services shall submit to the governor, lieutenant governor,
speaker of the house representatives, and presiding officers of
each standing committee of the legislature with jurisdiction over
the department a written report containing the findings of the
feasibility study and the department's recommendations.
       (d)  Pending the study and report of the feasibility of a
school-based influenza vaccination pilot program, the Department
of State Health Services may seek, receive, and spend money
received through an appropriation, grant, donation, or
reimbursement from any public or private source to implement the
pilot program.
       (e)  This Act expires September 1, 2009.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
