A BILL TO BE ENTITLED
 
AN ACT
  relating to the name, commissioners, and powers of the Aransas
  County Navigation District No. 1.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  The heading to Chapter 5001, Special District
  Local Laws Code, is amended to read as follows:
  CHAPTER 5001.  ARANSAS COUNTY NAVIGATION DISTRICT [NO. 1]
         SECTION 2.  Section 5001.001, Special District Local Laws
  Code, is amended to read as follows:
         Sec. 5001.001.  DEFINITIONS [DEFINITION].  In this chapter:
               (1)  "Commission" means the navigation and canal
  commission of the district.
               (2)  "Commissioner" means a member of the commission.
               (3)  "District" [, "district"] means the Aransas County
  Navigation District [No. 1].
         SECTION 3.  Chapter 5001, Special District Local Laws Code,
  is amended by adding Subchapter A-1 to read as follows:
  SUBCHAPTER A-1.  COMMISSION
         Sec. 5001.021.  COMMISSION; TERMS.  (a)  The district is
  governed by a commission consisting of five elected commissioners.
         (b)  Commissioners serve staggered four-year terms of
  office, with two or three commissioners' terms expiring January 1
  of each odd-numbered year.
         (c)  One commissioner is elected from each Aransas County
  commissioners precinct and one commissioner is elected from the
  district at large.
         Sec. 5001.022.  ELECTION OF COMMISSIONERS. On the uniform
  election date in November of each even-numbered year, the
  appropriate number of commissioners shall be elected.
         Sec. 5001.023.  COMPENSATION OF COMMISSIONERS.   
  Notwithstanding Section 62.070, Water Code, the commission shall
  set the amount of the compensation, office and travel expenses, and
  other allowances for the commissioners, other district officers,
  and employees who are paid wholly from district money.
         SECTION 4.  Section 5001.051, Special District Local Laws
  Code, is amended to read as follows:
         Sec. 5001.051.  DEFINITION [DEFINITIONS]. In this
  subchapter, "fund"[:
               [(1)     "Commission" means the navigation and canal
  commission of the district.
               [(2)  "Fund"] means a promotion and development fund
  created by the district.
         SECTION 5.  Chapter 5001, Special District Local Laws Code,
  is amended by adding Subchapter C to read as follows:
  SUBCHAPTER C.  PROPERTY MANAGEMENT
         Sec. 5001.101.  PURCHASE OR LEASE OF PROPERTY.  The district
  may purchase or lease property in the same manner as a county.
         SECTION 6.  (a)  The changes in law made by this Act do not
  affect the selection of the members of the navigation and canal
  commission of the Aransas County Navigation District serving before
  January 1, 2008.
         (b)  Notwithstanding Section 5001.022, Special District
  Local Laws Code, as added by this Act, on the uniform election date
  in November 2007, five members of the navigation and canal
  commission of the Aransas County Navigation District shall be
  elected. The members must possess the qualifications provided by
  Subsection (c), Section 5001.021, Special District Local Laws Code,
  as added by this Act. The members elected take office January 1,
  2008. The terms of the members elected from Aransas County
  commissioners precincts 1 and 3 expire January 1, 2009. The terms
  of the members elected from Aransas County commissioners precincts
  2 and 4 and of the member elected from the district at large expire
  January 1, 2011.
         (c)  The term of a member of the navigation and canal
  commission of the Aransas County Navigation District serving on
  December 31, 2007, expires on January 1, 2008.
         (d)  On the uniform election date in November of each
  even-numbered year, the appropriate number of members of the
  navigation and canal commission of the Aransas County Navigation
  District shall be elected to four-year terms as provided by
  Subchapter A-1, Chapter 5001, Special District Local Laws Code, as
  added by this Act.
         SECTION 7.  This Act takes effect September 1, 2007.
