SENATE JOINT RESOLUTION
proposing a constitutional amendment to require that funds
collected from retail electric customers for the system benefit
fund be dedicated for expenditure to provide for bill payment
assistance, customer education, and low-income home energy
conservation.
       BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Article XVI, Texas Constitution, is amended by
adding Section 73 to read as follows:
       Section 73.  The Legislature shall remit all funds collected
from retail electric customers into a dedicated account to fund
programs to benefit residential electric customers.  All funds
received into the account shall be appropriated on a biennium basis
to support programs authorized by the Legislature that provide for
bill payment assistance, energy conservation and weatherization
assistance, and customer education.
       SECTION 2.  This proposed constitutional amendment shall be
submitted to the voters at an election to be held November 6, 2007.  
The ballot shall be printed to permit voting for or against the
proposition:  "The constitutional amendment to require that the
fees collected from residential electric customers for bill payment
assistance, weatherization and energy conservation, and customer
education shall be used for those purposes and not for general
appropriation or taxation."
