A JOINT RESOLUTION
|
|
proposing a constitutional amendment to allow certain elected |
|
county or district officeholders to become a candidate for another |
|
office in a primary election held in the final year of the |
|
officeholder's term without causing the automatic resignation of |
|
the officeholder. |
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 65, Article XVI, Texas Constitution, is |
|
amended by adding Subsection (c) to read as follows: |
|
(c) Subsection (b) of this section does not apply to an |
|
officer who announces the officer's candidacy or becomes a |
|
candidate for the nomination of a political party that elects its |
|
nominees at a primary election if: |
|
(1) the primary election is held in the final year of |
|
the term of the office; and |
|
(2) the officer announces the candidacy or becomes a |
|
candidate during the period for filing an application for a place on |
|
the primary election ballot. |

SECTION 2. This proposed constitutional amendment shall be |
|
submitted to the voters at an election to be held November 6, 2007. |
|
The ballot shall be printed to provide for voting for or against the |
|
proposition: "The constitutional amendment allowing certain |
|
elected county or district officeholders to become a candidate for |
|
another office in a primary election held in the final year of the |
|
officeholder's term without causing the automatic resignation of |
|
the officeholder." |
