A JOINT RESOLUTION
  proposing a constitutional amendment to allow certain elected
  county or district officeholders to become a candidate for another
  office in a primary election held in the final year of the
  officeholder's term without causing the automatic resignation of
  the officeholder.
         BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 65, Article XVI, Texas Constitution, is
  amended by adding Subsection (c) to read as follows:
         (c)  Subsection (b) of this section does not apply to an
  officer who announces the officer's candidacy or becomes a
  candidate for the nomination of a political party that elects its
  nominees at a primary election if:
               (1)  the primary election is held in the final year of
  the term of the office; and
               (2)  the officer announces the candidacy or becomes a
  candidate during the period for filing an application for a place on
  the primary election ballot.
         SECTION 2.  This proposed constitutional amendment shall be
  submitted to the voters at an election to be held November 6, 2007.
  The ballot shall be printed to provide for voting for or against the
  proposition: "The constitutional amendment allowing certain
  elected county or district officeholders to become a candidate for
  another office in a primary election held in the final year of the
  officeholder's term without causing the automatic resignation of
  the officeholder."
