SENATE RESOLUTION
 
         BE IT RESOLVED by the Senate of the State of Texas, 80th
  Legislature, Regular Session, 2007, That Senate Rule 12.03 be
  suspended in part as provided by Senate Rule 12.08 to enable the
  conference committee appointed to resolve the differences on
  Senate Bill No. 593 (proof of, and providing notice to certain
  beneficiaries under, a decedent's will) to consider and take
  action on the following matters:
         (1)  Senate Rule 12.03(4) is suspended to permit the
  committee to add a SECTION to the bill to amend Section 6.02,
  House Bill No. 391, Acts of the 80th Legislature, Regular
  Session, 2007, to read as follows:
         SECTION 5.  Section 6.02, H.B. No. 391, Acts of the 80th
  Legislature, Regular Session, 2007, as effective September 1,
  2007, is amended to read as follows:
         SECTION 6.02.  The changes in law made by this article
  apply only to[:
               [(1)     the estate of a decedent who dies before the
  effective date of this article, if the probate or administration
  of the estate is pending on or commenced on or after the effective
  date of this article; and
               [(2)] the estate of a decedent who dies on or after
  the effective date of this article.
         Explanation:  The addition of the SECTION to the bill is
  necessary to make a technical change in the applicability of an
  amendment made by SECTION 6.01, House Bill No. 391, Acts of the
  80th Legislature, Regular Session, 2007, to Section 85, Texas
  Probate Code.
         (2)  Senate Rule 12.03(1) is suspended to permit the
  committee to change the text of the SECTION of the bill that is
  renumbered in the conference committee report as SECTION 6 to
  read as follows:
         SECTION 6.  The changes in law made by Sections 1, 2, 3,
  and 4 of this Act apply only to the estate of a decedent who dies
  on or after the effective date of this Act. The estate of a
  decedent who dies before the effective date of this Act is
  governed by the law in effect on the date of the decedent's death,
  and the former law is continued in effect for that purpose.
         Explanation:  The change to the applicability provision
  of the bill is necessary to reflect the addition of SECTION 5 to
  the conference committee report and to avoid having the
  applicability provision affect that added SECTION.
