LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

May 18, 2007

TO:
Honorable Tom Craddick, Speaker of the House, House of Representatives

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB41 by Paxton (Relating to the confidentiality of home address information of certain federal judges and state judges and their spouses.), As Passed 2nd House

No significant fiscal implication to the State is anticipated.

The bill would amend sections of the Election, the Government, and the Tax Codes to hide the home residence address in otherwise public records of certain federal and state judges and their spouses.

Additionally, the bill would amend Chapter 161 of the Human Resources Code by adding Section 161.075. The new section states that neither an Area Agency on Aging (AAA) nor one of its employees or volunteers that conducts an election for a Texas nonprofit organization would be held criminally or civilly liable for any act or omission regarding such election duties, including that relating to verifying qualifications of candidates and reporting election results, if the AAA (or employee or volunteer) acts in good faith and within the scope of its authority.

The bill would take effect September 1, 2007. It is anticipated that any additional work resulting from the passage of the bill could be reasonably absorbed within current resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
