No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code by requiring the Board of the Texas Department of Criminal Justice (TDCJ) to adopt a rule that allows the use of tobacco products and cigarettes by the employees and inmates of and visitors to TDCJ. The executive director of TDCJ must determine the designated smoking areas. TDCJ has determined that although there could be fiscal impact associated with increased health care costs and litigation related to exposure to second-hand smoke, no significant fiscal impact to TDCJ is anticipated.

No significant fiscal implication to units of local government is anticipated.
