LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

April 27, 2007

TO:
Honorable Kino Flores, Chair, House Committee on Licensing & Administrative Procedures

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB98 by Martinez, "Mando" (Relating to the transportation of alcoholic beverages between certain licensed or permitted premises.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Alcoholic Beverage Code relating to the transportation of alcoholic beverages between certain licensed or permitted premises.

The bill would amend the Alcoholic Beverage Code, Sections 22 and 24, which state that the owner of more than one package store who is also the holder of a local cartage permits may transfer alcoholic beverages between any of the owner's premises or storage locations in the same or adjacent counties. The bill would take effect September 1, 2007 and apply only to the transport of an alcoholic beverage on or after the effective date of the Act.

The Alcoholic Beverage Commission (TABC) states the fiscal impact to the state would be $11,000 in 2008 for a reprinting of the Peace Officer's Guide to include new regulations to implement the provisions of the bill.  It is assumed the TABC costs could be absorbed within the agency’s current appropriations and therefore would not result in a significant fiscal impact to the state.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
