LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

April 11, 2007

TO:
Honorable Rob Eissler, Chair, House Committee on Public Education

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB163 by Raymond (Relating to bullying as a ground for removing a public school student from class and placing the student in a disciplinary alternative education program.), As Introduced

No fiscal implication to the State is anticipated.

The bill would require placement of a student who knowingly engages in written, verbal, or physical bullying on or near school property or while attending a school-related activity in a disciplinary alternative education program.

The Texas Education Agency (TEA) indicates that modifications to the Public Education Information Management System required to record new disciplinary codes associated with the provisions of the bill could be achieved with current agency resources.

Local Government Impact

School districts would be required to update the Student Code of Conduct and local procedures.  School district would be required to update locally developed or vendor software to report DAEP placements for bullying conduct
