No fiscal implication to the State is anticipated.
The bill would require expulsion of students for certain off-campus conduct in which the student engaged while not in attendance at a school-sponsored event. Expulsion would be required for a capital felony or first degree felony for which the student receives deferred prosecution, as a result of a court or jury's determination that the student has committed a capital felony or first degree felony, or as a result of the superintendent's or superintendent's designee's reasonable belief that the student has committed a capital felony or first degree felony. The bill would entitle the superintendent or the superintendent's designee to consider all available information, including the contents of an arrest warrant, in establishing belief that a student has committed an offense for which expulsion is required under the provisions of the bill.
