No significant fiscal implication to the State is anticipated.

The bill would amend Section 247.031 of the Health and Safety Code to add counties to the list of governmental bodies which are authorized to require certain facilities within their jurisdiction to obtain assisted living facility licensure from the Department of Aging and Disability Services (DADS) in order to operate within the jurisdiction.


Local Government Impact

No significant fiscal implication to units of local government is anticipated.

The Department of Aging and Disability Services indicated that implementation of the bill could add additional responsibilities to counties that elect to pass resolutions pursuant to the bill. The agency indicated most counties already have county judges, code compliance officers, constables, sheriffs, deputies, and other existing staffs for enforcement but the counties could incur minimum travel costs associated with enforcing resolution, closing a facility, and moving residents from closed facilities to other existing facilities.
