The bill would amend the Business and Commerce Code to create as a Class A misdemeanor offense the use in an advertisement of a name or picture of a member of the United States Armed Forces, Texas National Guard, or national guard of another state without obtaining consent from the individual or their heirs if the individual is clearly identifiable in the photo.
A Class A misdemeanor is punishable by a fine not to exceed $4,000, confinement for no more than one year in county jail, or both a fine and confinement.
