The bill would amend the Business and Commerce Code to create as a Class A misdemeanor offense the use in an advertisement of a name or picture of a member of the United States Armed Forces without obtaining consent from the individual or their heirs.
A Class A misdemeanor is punishable by a fine not to exceed $4,000, confinement for no more than one year in county jail, or both a fine and confinement.
