HB361 by Pickett (Relating to listing certain small facilities furnishing care to residents.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would add new section 247.033, Listing of Certain Small Facilities to Chapter 247 of the Health and Safety Code.  The added language would require the executive commissioner of the Health and Human Services Commission (HHSC) to establish a system for listing certain small facilities that provide food, shelter, and personal care services to three or fewer people who are unrelated to the proprietor of the facility, and that provide regular care to the residents of the facility. 
 
The facilities would not otherwise be subject to the standards, requirements, or penalties of Chapter 247.  The facilities also would not be required to display the listing, but must make it available for examination.  The list would remain valid until surrendered. 

The bill would take effect September 1, 2007.

It is assumed that the Department of Aging and Disability Services would use existing resources to address the costs to generate the listing, provide the listed facilities copies, and make any necessary system changes.
