LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

April 27, 2007

TO:
Honorable Kino Flores, Chair, House Committee on Licensing & Administrative Procedures

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB411 by Eissler (Relating to requiring the registration of certain containers of alcoholic beverages; providing criminal penalties.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Alcoholic Beverage Code relating to requiring the registration of certain containers of alcoholic beverages.

The bill would amend the Alcoholic Beverage Code, Chapter 111 which would create a keg registration requirement for Texas.  The bill states the requirements for keg registration as well as the responsibilities of the retailer and consumer in the registration process.  The bill states any violation of this requirement would be a Class C misdemeanor. The bill would take effect on September 1, 2007.

The Alcoholic Beverage Commission estimates an additional $60,000 in professional service fees would be needed for computer programming changes in fiscal year 2008 in order to implement the required changes of the bill. This analysis assumes that these costs can be absorbed within the agency’s current appropriations.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
