No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code relating to municipal and county eligibility for federal grants related to commercial motor vehicle safety.

The bill would amend Transportation Code, Section 644.102 which states that municipalities or counties that engage in enforcement under this chapter may not be considered a party to a federal grant agreement or a grantee under the federal grant to the department, except as provided by subsection (b-1). Subsection (b-1) states that municipalities or counties from receiving High Priority Activity funds provided under the federal Motor Carrier Safety Assistance Program. The bill would take effect immediately if two-thirds of the House of Representatives and Senate members vote to enact the legislation.  If it does not receive the vote necessary for immediate impact, the bill would take effect on September 1, 2007.

The Department of Public Safety (DPS) anticipates that the bill would have no significant fiscal impact to the agency. The introduced version of the bill placed municipalities and counties in a grantee status relative to consideration of federal grant money to DPS.  However, this version of the bill removes municipalities or counties from any grantee consideration (in the context of a federal grant), but does not exclude them from receiving High Priority Activity Funds (grant money), through the Federal Motor Carrier Safety Assistance program.

No significant fiscal implication to units of local government is anticipated.
