LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

February 16, 2007

TO:
Honorable David Swinford, Chair, House Committee on State Affairs

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB609 by Smith, Todd (Relating to the application and enforcement of municipal construction codes.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend Section 214.212(b), Local Government Code, authorizing the governing body of a municipality by ordinance to apply the International Residential Code (IRC) and any code amendments to construction, alteration, remodeling, enlargement, and repair of residential structures in the extraterritorial jurisdiction (ETJ) of the municipality. The bill would repeal Section 212.049, Local Government Code, which would otherwise conflict with the change in authorizing a municipality to apply the IRC in the ETJ.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
