No significant fiscal implication to the State is anticipated.

The bill would amend Section 61.004, Local Government Code, to allow the governing body of each municipality holding a consolidation election to hold the election on the same date. Under current statute, the municipality with the smaller population of those that would be involved in the consolidation is required to hold the election first.

The bill would also change the timeframe in which a consolidation election would be held. Under current statute, the election is required to be held on the first authorized uniform election date prescribed by the Election Code that occurs on or after the 30th day after the date the election is ordered. The proposed amendment to the statute would require the election to be held on the first authorized uniform election date after the period required by Section 3.005, Election Code (not later than the 62nd day after the election is ordered).
