No significant fiscal implication to the State is anticipated.

The bill would amend the Insurance Code by requiring a health insurance company that does not already provide coverage for emergency or other medical, hospital, or surgical expenses incurred by the insured to include a provision in the policy releasing the insurer from liability for certain losses sustained as a consequence of the insured being intoxicated or under the influence of any narcotic, unless administered by a physician.  The bill would require the commissioner to adopt rules necessary for the implementation of the bill.

Based on the analysis of the Texas Department of Insurance, Employees Retirement System, and Teacher Retirement System, it is assumed that duties and responsibilities associated with implementing the provisions fo the bill could be reasonably absorbed within existing resources.

The bill would take effect September 1, 2007.
