No significant fiscal implication to the State is anticipated.

The bill would amend the Penal Code clarifying the offense definition of improper photography or visual recording.  Under the provision of the bill, posting a sign indicating the person is being photographed or recorded at a location where a person has a reasonable expectation of privacy, is not sufficient to establish consent.

 

The bill would take effect September 1, 2007 and apply only to an offense committed on or after the effective date of the Act.
